Can an employer change the conditions of a signed offer?
Accepted a job with the notion that I would be eligible for the bonus program. This eligibility was stated in my offer letter signed by me and company officials. Months later, HR comes to me and says that they made a mistake - I'm not eligible to be in the program yet.
Can they do this? I understand that employment is not a contract, but isn't the offer letter a formal documented "promise" - a letter of intent?
If you want to push the issue, talk to an attorney. An offer letter is a contract - you accepted the position based on the information therein.
Discuss the problem with your supervisor, if you have a good relationship with that person. Make it clear that you accepted the position as offered in the letter in good faith, and expect the company to exercise good faith in honoring their agreement.
Understand, though, that you may be alienating your employer if you push the issue. You must weigh the potential benefit of the promised bonus program (is it objective or subjective?) against the possibility of being labeled a troublemaker.
